They may look kinda alike, but the legal system of Canada and the USA are
very different.  The USA is based on English Common Law, the Canadian
system is based on a French Republic model.

Under English Common Law, trespass is a tort, not a criminal act.  You can
recover damages for what the trespasser does, but you can only file 
criminal complaints if you can demonstrate that the trespasser entered the
premises with the intent to cause harm.

I don't know what the French system is like.
