[Toxicology] Alcohol death

Case is a young man starting drinking at 10:00 pm and reported to have stopped drinking at 10:30. It is alleged that he did not consume any additioanl alcohol after that time.  He arrived home at about midnight and died at 3:50 am with a BA of .37.

In my conclusion correct in that he would have had to drank additional alcohol between 10:30 and midnight?

Can his BA have been going down at the time of his death or does death occur at his peak of .37?
